OSHKOSH, WI (WTAQ-WLUK) — The Winnebago County District Attorney says no criminal charges will be filed against the Oshkosh police officer who shot an armed man in the Fleet Farm parking lot.
D.A. Eric Sparr says the officer’s use of force was justified in the May 10 shooting of Robert Lapp.
Shortly after 8:15 a.m., an officer with the Oshkosh Police Department was called to Fleet Farm for a reported firearm theft, according to the Wisconsin Department of Justice. Dispatch audio archived on a public website indicates a store employee first called police.
“They had a customer who they were showing a gun to and he tried loading the gun with ammo that he brought into the store himself,” a dispatcher said.
Lapp was described as an older man. Store staff did not know his exact location, but said Lapp still had the silver handgun with him when the reporting person left him. The dispatcher said it was believed the gun was down the man’s pants.
A uniformed police officer, who’s name was not released, pulled into the store’s parking lot moments later and saw Lapp. “He pulled the gun on me, shots fired,” the officer said, seconds after arriving on scene.
According to the DOJ, Lapp did not comply with the officer’s commands and continued walking towards the officer, retrieving a firearm from his waistline. The officer fired their weapon, hitting Lapp. A firearm was recovered at the scene. There was no indication if Lapp fired the gun.
