APPLETON, WI (WTAQ-WLUK) – A plea deal has been reached in a Kaukauna murder, which would reduce the maximum prison sentence from life to 60 years.
Dontae Payne, 29, is currently charged with first-degree intentional homicide and armed robbery for the March 30, 2021 death of Brian Porsche at a home on West Division Street.
However, according to a plea questionnaire and waiver of rights form filed Tuesday, Payne has agreed to plead no contest to second-degree intentional homicide. He is currently scheduled to go to trial July 12.
A Nov. 16 hearing has been scheduled to formalize the plea and set a sentencing date.
Previously, Tanya Stammer, 31, was sentenced to 23 years in prison for her role in the death. She was also convicted of second-degree intentional homicide.
According to the criminal complaint, Payne and Stammer targeted Porsche. Payne allegedly shot Porsche. The two then tried to make the scene look like a robbery, and tossed his phone and keys into Lake Winnebago.
